Official Rules of GoldenFairway.com® Golf Game

This page contains the Official Rules of the GoldenFairway.com® game (the "Rules") of the licensor of our virtual golf course. The GoldenFairway.com game (the "Game") is subject to the availability of the GoldenFairway.com web site including all of its web pages (the "Website"). No purchase or other consideration is necessary to play or win the Game. Game players must be at least 18 years old to win. The Game is void where prohibited by law. Use of the Game and the Website are completely voluntary.

HOW TO PLAY THE GAME: To win prizes, Game players must play online golf on the GoldenFairway.com completing 18 holes per game. If a player plays all 18 holes, the player receives a game score in the account they, the player, sets up at the time of enrollment. The score can only be redeemed from individual accounts, combining accounts and scores is not accepted.

GUARANTEE: To be eligible under this Guarantee, a player must begin play by Registering for the Golf Game, then playing a game. When a game is completed the score is awarded to the player’s personal account.

When a player shuts down his or her computer or Internet connection , or if a player's computer or Internet connection crashes or ceases to operate in any manner, or if the Game or Website crashes or experiences technical problems The score will not be awarded to the player’s account. If a player stops playing the Game or does not actively complete a Game for any reason the score will not be awarded and will not be eligible to win. If a player re-commences playing the Game after having stopped for any reason, the player will be required to start over and play a complete Game in order for this Guarantee to apply. The Company is not responsible if, for reasons beyond the control of Company, a player is unable to play the Game, accumulate a score, or access their personal account. For example, the Company is not responsible if a player is unable to access their personal account because of issues arising from the player's computer and/or Internet connection, such as an Internet connection problem or a firewall. Also, the Company is not responsible if a player uses a cookie blocker or if a player's cookie (which keeps track of a player's accumulated score) is destroyed, erased, or otherwise ceases to operate for any reason. By playing the Game, each player agrees (a) to abide by the terms of this Guarantee, and (b) to abide by these Rules.

Golf scores are units with value used for prizes which players can accumulate. Cookies must be enabled on a player's computer in order for a player to accumulate their score. Cookies need not be enabled in order to play the Game, but they must be enabled to take full advantage of all features of the Game. (For more information about cookies, go to http://www.cookiecentral.com.) A score may also be obtained through promotional offers on the Website. A players winning score may be redeemed for travel coupons, prizes, and other special offers and promotions. Scores by themselves have no cash value. The Company is not responsible for lost scores under any circumstances. The Company reserves the right to remove or revalue scores at any time.

Tie Breaker: In the event of a tie. The player with the lowest elapsed play time will be deemed the winner. Time spent viewing Ads and the score card does not increase elapsed play time.

PRIZES: Prizes available in the Game may vary each day. A list of current available prizes is posted on the Game site and is updated throughout the day as prizes are added, removed, or won. Vacation prizes are transferable, the other Prizes are not transferable. All national, state, provincial, local and other taxes or tariffs of any kind are the sole responsibility of the winning player. Players cannot combine scores from multiple accounts

HOW TO CLAIM PRIZES: Winning players are automatically mailed a prize at the end of each tournament. The information provided at game registration online must be valid in order to claim the prize. The Game is open to eligible players who have Internet access. All players must provide their own computer and Internet service and are responsible for their Internet connection. Internet access will not be considered a fee associated with playing the Game. Players must be 18 years of age or older to play the Game. The Game is null, void and unavailable in every national, provincial, state, local or other jurisdiction in which it is prohibited, regulated or restricted by any law, statute, regulation or appropriate authority. The Company and its agents, affiliates and sponsors make no express nor implied warranties or representations of any kind either (1) that the Game may be legally played in any particular locale or jurisdiction, or (2) that any player may lawfully participate in the Game. Players must determine for themselves whether they can legally play the Game and win prizes. By playing the Game, each player acknowledges and agrees that he or she has read and will abide by these Rules, and that he or she is at least 18 years of age, and that he or she is not prohibited from participating in this Game by any applicable law, statute, regulation or other appropriate authority. Employees and their immediate families (including persons living in the same household) of the Company and its affiliates are not eligible to participate in the Game. Employees of the Company's retailers, suppliers, agents and advertising or promotional agencies and their immediate families (including persons living in the same household) are not eligible to participate in the Game. Residents of Canada will be required to correctly answer a time-limited mathematics skill test administered by mail prior to being awarded a prize. The Game is void in the province of Quebec, Canada. Because of the nature of the Internet, the Company is unable to prohibit Quebec residents from playing the Game, but no prizes will be mailed to Quebec residents.

No purchase necessary . If you do not want to pay a fee to play 18 holes of golf on the GoldenFairway course, just send a request for prize offered by United States Postal Service Certified mail including a return receipt for proof of delivery to GoldenFairway.com, 7701 Forsyth Blvd., Suite 325, St. Louis, MO 63105. You will receive prize offered FREE. All requests must include full name and mailing address and a self-addressed return envelope with first-class postage attached. Limit one (1) request per household.

Summary of official promotion rules and how to play "BUST THE BANK"tm. 1. NO PURCHAS NECESSARY TO PLAY. Void where prohibited by law. 2. Scratch off any five (5) squares on the Scratch Card. If you reveal the five (5) identical symbols, you are an instant prize winner, subject to verification. The number of stars in the "Special Play" box determines the prize level for which you are eligible. 3. SCRATCH CARD IS VOID AND WILL NOT BE ELIGIBLE FOR PRIZE REDEMPTION IF (1) MORE THAN FIVE (5) SQUARES AND THE "SPECIAL PLAY" BOX ARE REVEALED, IN WHOLE OR IN PART, OR (2) THERE ARE ANY MARKS OR SCRATCHES ON THE CARD OTHER THAN THE (5) REVEALED SQUARES AND "SPECIAL PLAY" BOX. 4. The scratch card is non-transferable and may only be played by the person to whom it was distributed by the promotion sponsor. 6. All scratch cards presented for prize redemption are subject to verification by an independent judging organization whose decisions are final. UNCLAIMED PRIZES WILL NOT BE AWARDED. Taxes, if any, are the sole responsibility of the winner. 7. Odds of any five scratched squares revealing the five winning symbols are 1:53,130. PLAYER CONDUCT: The Company reserves the right, in its sole discretion, to disqualify any individual from playing the Games, including for the following behavior: (a) tampering with or hacking with the Game or the Website, (b) acting in violation of these Rules, and (c) acting in an annoying, abusive, threatening or harassing manner. Players may only use web browser programs such as Netscape Navigator, Netscape Communicator or Microsoft Internet Explorer (or equivalent web browsers) to play the Game. Use of any other software not designed for browsing the World Wide Web is not allowed. No electronic devices or software may be used to automate web browsers to play the Game, and no electronic devices or non-browser software programs may be used to play the Game. Players must use a web browser that supports Java, JavaScript and cookies, and these technologies must be enabled to take advantage of all the features of the Game. Only players with Java support enabled on their browser will be given the opportunity to play.

Any fraudulent attempts to claim prizes or circumvent these Rules or the operation of the Game may subject such individual to civil and criminal liability and prizes will not be issued.

LIMITATIONS OF LIABILITY AND DISCLAIMERS: The Company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Game and the Website. The Company is not responsible for any problems or technical malfunctions beyond the reasonable control of Company, including without limitation problems arising from a player's computer equipment, computer server, Internet connection, Internet service provider, firewall, telephone, cable, or satellite line, other utilities, computer online systems, software, failure of e-mail, traffic congestion on the Internet, or other problems. If, for any reason, the Game and the Website do not operate as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Game which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Game and the Website, the Company reserves the right, in its sole discretion, to immediately cancel, terminate, modify or suspend the Game and the Website. The Company is not responsible for the actions or omissions of any third parties. The Company is not responsible for technical errors which might result in the erroneous awarding of prizes.

AGREEMENT TO BE BOUND: By playing the Game, players expressly agree: (1) to be bound by these Rules, the GoldenFairway.com Privacy Policy, and any other rules and terms and conditions of the Game which appear on the Website or game card, (2) to be bound by the decisions of the Company concerning the Game; and (3) to release the Company, its owners, directors, officers, employees, agents, affiliates, successors, and assigns from any and all liability associated with the Game and the Website.

CHOICE OF LAW: By participating in the Game, players expressly agree to resolve any dispute, disagreement, claim, or lawsuit arising as a result of the Game or the Website under the laws of the State of Missouri, U.S.A.

CHOICE OF VENUE: Players participating in the Game and using the Website expressly agree to bring any action or lawsuit for damages or other relief against the Company in the District Court of St. Louis County, Missouri, U.S.A.
